1. Acceptance of Terms

By accessing and using the Buyers Playground website and its Services (the “Site”), you agree to comply with and be bound by these Terms of Service (“ToS”). These ToS govern your use of the Site for buying, selling, and trading goods across Guyana and the wider Caribbean region. If you do not agree to these terms, you must not use the Services.

2. The Site’s Role

Buyers Playground operates solely as an online venue and classifieds platform. We connect buyers and sellers; we are not a party to any transaction between users, nor are we a retailer, auctioneer, or delivery agent.

  • We have no control over the quality, safety, legality, or truthfulness of the items or services listed, the accuracy of the listings, or the ability of sellers to sell items or buyers to purchase items.

  • We do not handle payments, shipping, or the fulfillment of guarantees between users.

3. User Registration and Accounts

  • You must be at least 18 years old or the age of majority in your jurisdiction (Guyana, Caribbean territory, etc.) to use the Services.

  • You agree to provide accurate and complete information during registration and keep your password secure. You are responsible for all activities that occur under your account.

4. Listing Rules and Content Standards

  • Accuracy: All listings must be accurate, truthful, and relevant to the category posted. Misleading or fraudulent listings are strictly prohibited.

  • Prohibited Items: You agree not to list or sell items that are illegal, stolen, require a license you do not possess, violate copyright/trademark law, or are specified in our Prohibited Items Policy (e.g., weapons, illegal drugs, prohibited financial services).

  • Content: You are solely responsible for the content you post, including text, photographs, and video. You warrant that you own or have the necessary licenses to use all content submitted.

  • Free Service: Standard listing is free. We reserve the right to charge for optional premium features (e.g., “Featured Ad”).

5. Safety and Transactions

  • Due Diligence: Users are solely responsible for conducting their own research and due diligence regarding potential buyers, sellers, and listed items.

  • Safety: You agree to follow all safety guidelines, including meeting in public locations and exercising caution when exchanging personal information or currency.

  • Transaction Risk: You acknowledge and accept the risks associated with buying and selling goods with unknown parties. Buyers Playground assumes no liability for any loss, injury, or damages arising from transactions conducted on the Site.

6. Termination

We reserve the right to terminate or suspend your access to the Services, without prior notice or liability, for any reason, including but not limited to breach of these ToS, violation of community guidelines, or if we suspect fraudulent or illegal activity.

7. Disclaimer of Warranties

THE SITE AND ALL LISTINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Buyers Playground EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Buyers Playground, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

9. Governing Law

These Terms shall be governed by the laws of Guyana, without regard to its conflict of law provisions.
